Terms and Conditions

Article 1 – Designation of the seller

This website brume-orpin.com is published by the company BRUME ORPIN, SAS with capital of 50,000 euros whose head office is located at 75 Boulevard Haussmann in Paris (75008) registered with the RCS of Paris, SIREN 828 675 421, VAT FR83 828675421.

Article 2 – General provisions relating to these general terms and conditions of sale (hereinafter the GTC)

  1. 1. Purpose of the T&Cs

The T&Cs are applicable exclusively to the online sale of BRUME ORPIN products on the website brume-orpin.com (hereinafter the website), access to which is subject to registration.

  1. 2. Scope of application of the GTC

These General Terms and Conditions of Sale (hereinafter the " GTC ") apply to all orders for Products placed through the Site, with the exception of "special orders" or "custom-made" products, by end consumers. The GTC, together with the online order, constitute the contractual documents binding on the parties, to the exclusion of all other documents, prospectuses, catalogues or photographs of the products which have only an indicative value. The GTC are exclusively applicable to products delivered to consumers established in France and/or in a member country of the European Union.
The T&Cs are written, as well as all contractual information mentioned on the site, in French.

  1. 3. Availability and enforceability of the T&Cs

The T&Cs are made available to consumers on the seller's website where they are directly available. The T&Cs are binding on the consumer who acknowledges, by checking a box provided for this purpose, having read and accepted them before placing an order.
Validation of the order by its confirmation constitutes acceptance by the buyer of the General Terms and Conditions in force on the day of the order, the conservation and reproduction of which are ensured by the professional seller in accordance with article 1127-2 of the Civil Code (former C. civ., art. 1369-4).

The professional seller reserves the right to modify its T&Cs at any time.
In the event of modification of the General Terms and Conditions, the applicable General Terms and Conditions are those in force on the date of the order, a copy of which dated on that date may be provided to the consumer upon request.

  1. 5. Clauses of the T&Cs

The invalidity of a contractual clause does not entail the invalidity of the General Terms and Conditions. The temporary or permanent non-application of one or more clauses of the General Terms and Conditions by the professional seller cannot be considered a waiver on its part of the other clauses of the General Terms and Conditions which continue to produce their effects.

Article 3 – Products

The products offered for sale presented in the catalog published on the site are each the subject of a description mentioning their essential characteristics within the meaning of article L. 111-1 of the consumer code.
The photographs illustrating the products do not constitute a contractual document.

The site offers perfumes for sale as well as a complementary scented range. These products are intended for individuals only.
BRUME ORPIN cannot be held responsible for damage caused by improper use of the products sold on its site or by failure to comply with the precautions for use.

  1. 3. Compliance

The products comply with the requirements in force relating to the safety and health of people, the fairness of commercial transactions and consumer protection at the time they are placed on the market. The products comply with the requirements of French law in force at the time they are placed on the market.

  1. 4. Stock availability

Products are offered and delivered within the limits of available stocks.
In the event that the product ordered is unavailable, the seller shall immediately inform the buyer and may offer a product of equivalent quality and price or, failing that, a voucher for the amount of the order that can be used for any future order.
In the event of disagreement by the buyer, the seller will reimburse the sums paid within 5 working days.
Apart from the reimbursement of the price of the unavailable product, the seller is not liable for any cancellation compensation.

Article 4 – Prices

  1. 1. Selling price

The sales prices, in accordance with Article L. 112-1 of the Consumer Code, are indicated, for each of the products appearing in the electronic catalogue, in euros including all taxes, excluding delivery and transport costs mentioned before validation of the order and invoiced in addition.
The total amount owed by the consumer is indicated on the order confirmation page.
The sale price of the product is that in effect on the day of the order.
In the event of a price promotion, the professional seller undertakes to apply the promotional price to any order placed during the period of advertising for the promotion.

  1. 2. Modification

The professional seller reserves the right to modify its prices at any time, while guaranteeing the consumer the application of the price in effect on the day of the order.

  1. 3. Fees

Additional transport, delivery or postage costs, which the customer may have been aware of before ordering, are indicated when the consumer validates the order.

  1. 4. Duties and Taxes

The prices indicated by BRUME ORPIN are exclusive of duties and taxes relating to the country of delivery and will be the sole responsibility of the consumer. BRUME ORPIN cannot be held responsible and cannot replace the consumer for any payment or dispute with the authorities in force.

Article 5 – Offer

Online sales offers are available for many countries.

  1. 2. Duration

The online sales offers presented on the site are valid, in the absence of any indication of a specific duration, as long as the products appear in the electronic catalog and within the limit of available stocks.

  1. 3. Acceptance

Acceptance of the offer by the consumer is validated, in accordance with the double-click process, by confirmation of the order.

Article 6 – Order

  1. 1. Steps for concluding the contract

To place an order, the consumer, after having filled his virtual basket by indicating the selected products and the desired quantities, then clicks on the “Order” button and provides the information relating to delivery and the payment method.
Before clicking on the "Confirm order" button, the consumer has the possibility to check the details of his order and its total price and to return to the previous pages to correct any errors or possibly modify his order.
Confirmation of the order entails acceptance of the General Terms and Conditions and forms the contract.
An email acknowledging receipt of the order and payment is sent by the seller as soon as possible.

  1. 2. Order modification

Any modification of the order by the consumer after confirmation of the order is subject to acceptance by the professional seller.
The professional seller reserves the right to make modifications to the product ordered which are linked to technical developments under the conditions provided for in article R. 212-4 of the consumer code.

The professional seller reserves the right to refuse any order for legitimate reasons and in particular if the quantities of products ordered are abnormally high for buyers with the status of consumers.

Article 7 – Contract

The sales contract is formed at the time the consumer sends confirmation of his order.

The archiving of communications, purchase orders and invoices is carried out on a reliable and durable medium in order to constitute a faithful and durable copy in accordance with Article 1360 of the Civil Code (former Civil Code, Art. 1348). These communications, purchase orders and invoices may be produced as proof of the contract.

Article 8 – Payment

The price is payable in full after confirmation of the order. Payment is made immediately upon ordering by credit card.

  1. 2. Payment security

The site is equipped with an online payment security system that allows the consumer to encrypt the transmission of their banking data via the electronic payment server of the secure payment platform. At no time will the consumer's banking data pass through the BRUME ORPIN computer system.

Article 9 – Delivery

Delivery means the transfer to the consumer of physical possession of the good

The professional seller will process the order as soon as possible from Monday to Friday. Orders are processed every business day.

  1. 3. Delivery time

Delivery times vary depending on the geographical area. BRUME ORPIN cannot be held responsible for a delay in delivery. The indicative delivery times are:

- France: 48 hours,

- Europe: average delay of 3 days,

- outside EU: average delay of 3 to 5 days,

- Other countries: 3 to 10 days

  1. 4. Delay in shipping

In the event of a delay in shipping, BRUME ORPIN must inform the customer.

  1. 5. Place of delivery

The products are delivered to the address indicated by the customer on the order form.

  1. 6. Product conformity

If the product does not conform to the order, the consumer must send a complaint to the professional seller in order to obtain the replacement of the product or possibly the resolution of the sale. Requests should be sent to bonjour@brume-orpin.com

  1. 7. Transfer of ownership

From the delivery date indicated in the order form, ownership of the product is transferred to the buyer, except in the case where full payment of the price has not been collected upon ordering.

Article 10 – Return of Products and right of withdrawal

The consumer has a right of return of fourteen days from receipt of his order to return any item that does not suit him and request an exchange or a voucher, excluding return costs to be borne by the consumer. Returns must be made in their original condition and complete allowing their re-marketing in new condition, accompanied by the purchase invoice. Any opened or damaged product will not be exchanged, refunded or given a voucher.

The right of withdrawal can be exercised online via the address bonjour@brume-orpin.com . If you use this option, we will send you without delay an acknowledgment of receipt of the withdrawal on a durable medium (for example, by email).
The right of withdrawal can only be exercised if the products are returned in their original condition, allowing their re-marketing. In the event of withdrawal, BRUME ORPIN will send a purchase voucher equivalent to the value of the product, excluding additional costs.

Article 11 – Processing of personal data

BRUME ORPIN processes consumer information in accordance with the GDPR

Article 12 – Dispute Resolution

BRUME ORPIN cannot be held responsible for damage resulting from improper use of its products.
In the event of a dispute, you must first contact the company's customer service by email (bonjour@brume-orpin.com) in order to attempt to resolve this dispute informally.

Article 13 – Applicable law

This contract and the General Terms and Conditions governing it are subject to French law.


Article 14 - INTELLECTUAL PROPERTY

The content of the Site is the exclusive property of BRUME ORPIN Parfum.
Under no circumstances is the Customer authorized to download or modify all or part of the Site and in particular its content (listed products, descriptions, images, videos, etc.).

The Site or any part of the Site may not under any circumstances be reproduced, copied, sold or exploited for commercial or professional reasons without the express, written and prior authorization of BRUME ORPIN Parfum.

In general, BRUME ORPIN Parfum remains the owner of all intellectual property rights on the photographs, presentations, brands, bottles, packaging and other distinctive signs appearing on the Site. The Customer therefore prohibits any reproduction or exploitation of said rights and aforementioned elements, without the express, written and prior authorization of BRUME ORPIN Parfum which may make it conditional on financial compensation.
